Your website may be migrated incorrectly or not at all. ColdLayer has no personal, legal or penal liability for any damages that may arise from this situation.
The conditions of all services provided by ColdLayer are regulated according to the Constitution of the Republic of Türkiye and the laws of the country where the data centers are in cooperation.
You may not impose any legal liability on ColdLayer by using the services provided by ColdLayer. You are solely responsible for any action you take using the services provided to you.
Violating any copyright or registration rights by using our services is prohibited. These include unauthorized music, books, photographs or other copyrighted material. In addition, obscene, personal or commercial attack, terrorism content and content that can be used for hacking cannot be hosted, which violates any right and restricts any freedom as required by law. Selling against copyright/registration rights and/or hosting unlicensed and/or illegally prohibited content will result in the immediate termination of the service(s) you receive. If the specified contents are found, these contents will be deleted or access to the content will be blocked. In case of recurrence, the service may be suspended/terminated.
Complaints about illegal actions made using services provided by ColdLayer may not be terminated if ColdLayer is unable to verify the cause of the complaint or is unsure whether the action is criminal. ColdLayer has no legal decision-making authority. In such cases, you must legally seek your rights against the person who committed this action. ColdLayer does not have any personal, legal or penal responsibility for any material/moral damages and losses that may occur in such cases.
All services offered by ColdLayer are for use only within the limits permitted to you. If, in any way, you access a content/file/service that you are not authorized to, it is your responsibility to notify ColdLayer without using it. Otherwise, it is your responsibility to cover any material/moral damages you may cause.
ColdLayer may monitor site contents and/or any access for legal reasons, system administration purposes, tracking unauthorized access, verifying security procedures and/or operational security. This responsibility also includes the username and password. You should use a secure and unpredictable password for your accounts. You are also responsible for any malware that may be installed on ColdLayer servers in any way using your account. Where necessary, ColdLayer reserves the right to terminate your services without refund or partial refund. ColdLayer has the right to request from you the modification/removal of any website, database, account or any other material/service it deems inappropriate. In this regard, the user is obliged to fulfill ColdLayer's request.
ColdLayer has no tolerance for spam, and bulk emailing. If you do not comply with this issue, the service(s) you receive will be terminated with/without notice. All services that cause the IP address and/or IP block used in the service to enter the email blacklists will be terminated without notice.
If the IP address and/or IP block is included in the email blacklists, ColdLayer has the right to charge the person/enterprise that caused it to charge the necessary fee to correct this situation. This fee is ColdLayer independent and will be used to clear the IP address and/or IP block from email blacklists. By taking service from ColdLater, in such cases, you will pay the required fee, without objection, within the requested time and if this situation occurs; You agree and undertake that you will pay the necessary compensation in case of disruption of the service(s) provided/provided by ColdLayer to other ColdLayer users.
As long as you receive service from ColdLayer, you agree to pay ColdLayer for the service you receive. As long as you do not cancel the service you have received, the service will continue to be renewed and an invoice will be created for the service you will receive. If you do not want to continue receiving the service, you must indicate that you want to cancel at least 15 days in advance, so that your service will be canceled as soon as possible or after the time you have paid according to your request.
Service cancellation must be done from your user control panel. On the Cancellation page, there are options for canceling the service as soon as possible or when it expires.
Unless canceled at least 15 days in advance, ColdLayer has the right to legally collect the fee for unpaid accounts, as ColdLayer's arranging stock management, may adversely affect the resale of the service as early as possible and the healthy continuation of reservations.
As long as you receive services from ColdLayer, you have a responsibility to keep your payment information up to date and pay your bills on time. If the invoice is not paid on time, ColdLayer may give you an additional 3 days to pay the invoice for email hosting, web hosting and reseller hosting accounts/services, after which your service will be suspended. ColdLayer may retain your data for up to 30 days after the due date, so that you can reactivate your hosting service by adding a delay fee of 1.5% of the invoice amount per day. If the payment is not made after 30 days after the last payment date, the service you receive will be terminated and your user data on your hosting will be permanently deleted. ColdLayer reserves the right to offer/not offer an additional 3 days and/or 30 days of data retention. In cloud/virtual/vps/vds server and dedicated/physical/rental server services, if payment is not made on the last payment day, your accounts will be terminated immediately and user data for the services will be deleted. ColdLayer cannot be held responsible in any way for material/moral damages and data loss that may arise in this regard.
Accidental and/or knowingly overpayments will be added to your account as balance/credit and no refund will be made for any reason. You can use this added balance/credit for your next services from ColdLayer.
ColdLayer reserves the right to change the prices of the products at any time without notice.
If the disk space, traffic and similar resources of your purchased services are used more than the purchased amount, ColdLayer will charge you for the resources used. In such a case, you are responsible for paying the required fee within the requested time, without objection. If it is not paid, your service will be terminated without a refund, and ColdLayer will not be responsible for material/moral damages and data loss in this regard.
It is your responsibility to cover all material and moral damages given to ColdLayer in case of withdrawals (dispute, chargeback, etc.) made using payment channels without the knowledge and/or consent of ColdLayer.
You are responsible for all your data while using our services. ColdLayer may offer backup service for your convenience, may sell backup space service, but does not guarantee any backups. ColdLayer cannot be held responsible for any data loss you may experience for any reason.
ColdLayer reserves the right to terminate any service it provides at any time, with or without notice, with/without refund or partial refund, without giving any reason.
Insulting ColdLayer and/or any ColdLayer employees, officials, officers will cause suspension/termination of your account/service/services. In such a case, your account/membership will be terminated without any refund and the contract will be terminated.

In case of a contrary behavior, you accept and undertake that you are under the obligation of material and moral compensation.
Attacked sites that directly or indirectly damage ColdLayer servers and/or cause problems such as slowdowns and interruptions may be terminated without notice and without refund. In such cases, ColdLayer may demand that you cover the damage incurred. In such a case, you are responsible for paying the required fee within the requested time, without objection.
For paid services, if the service is canceled before the end of the service period (due to use contrary to the service contract, user request, etc.), the full service fee or the fee for the unused time will not be refunded. You can use the balance/credit in your account for the services you can get from ColdLayer. No refunds will be made for services that will be terminated early or no balance/credit will be added to your account.

You can install a Secure VPN service on multiple devices, but only one connection can be active at a time for each user account. When you use ColdLayer Secure VPN, only the moment you establish all/every connections, the duration of your connection, the moment your connection ends and the device, location, IP address, date, etc. at these moments. records are kept. It is not possible for us to see, record and log the processes such as your data flow and the web pages you enter during your connection, as the connection is completely encrypted.
In the domain names service ColdLayer, ICANN and registrars which are in the position of the main producer of the intermediate service, provide you with the service by complying with the conditions of the enterprises. All responsibilities and processes in this regard are valid as the conditions of registrars enterprises, but name registration and transfer processes are managed by software systems. These softwares work on ColdLayer and registrars enterprises. Due to malfunctions or access problems that may occur during this work, dns and whois update, change, transfer operations, etc. The user is responsible for the control of the entire process in case of errors and/or delays in the processes of the transactions. ColdLayer cannot be held responsible in any way.
ColdLayer will carry out the domain name registration and transfer transactions that have been ordered by the user and paid for without any problems. The owner of the registered and transferred domain names is the user. ColdLayer will be able to act on the domain name in line with the user's demands.
Responsibility for changing and correcting whois information in domain names, responsibility for registration/transfer password, responsibility for transfer lock belongs entirely to the user. ColdLayer does not assume these responsibilities. ColdLayer provides domain properties/settings to the user's management.
ColdLayer sends a notification email to the user's email address near the expiration of the domain name, stating that the domain name is about to expire and needs to be extended. ColdLayer cannot be held responsible for material and moral damages that may occur in cases such as not sending the email or not reading the email on time. The user is obliged to follow the duration of the domain names.
If the user wants to transfer the domain name in his ColdLayer account to a different business, a different location/business and/or registrar, the user must do this with the location/business and/or registrar that will receive the transfer, within the framework of ICANN rules. If the user requests it from ColdLayer, ColdLayer will ensure that the transfer lock is unlocked and the transfer password is transmitted for the transfer process. This process covers domain names with transfer feature.
SSL certificates are provided by businesses called trusted root certificate providers, and ColdLayer offers ssl certificate services through trusted root certificate providers.
Since domain names and ssl certificates are not products/services produced by ColdLayer itself and provide brokerage services, there are no refunds for these services since both domain name and ssl certificate providers do not offer refunds for domain name and ssl certificates.
The service/services received by users who constantly make backups that ColdLayer considers unnecessary may be suspended/terminated with/without notice. This article states that the server is damaged, slowed down, etc. by using the backup service for purposes other than backup situations apply.
Unlimited web hosting services include hosting only your website files and only your website traffic.
Unlimited web hosting space(s) cannot be used for data storage and/or backup/archive space.

ColdLayer reserves the right to waive the right to offer the service(s), feature(s) to the user free of charge.
Free offered, promotion, gift, trial, test, pilot, etc. At the stage of providing/receiving services and features, detailed information and conditions can be found regarding the free use of the service and feature. In these conditions, if the conditions are not met and/or the conditions provided are no available or are no longer available, ColdLayer shall have the right to terminate the service, which is offered free of charge, with or without notifying the user.
ColdLayer undertakes to pay compensation if the guaranteed 99% uptime guarantee is not fulfilled. Interruption affecting the uptime rate for the relevant service in the current calendar month, etc. for situations. ColdLayer is not responsible for your cloud/virtual/vps/vds server and dedicated/physical/rental server to be operational and/or accessible. In such cases, ColdLayer will not be aware of the problem unless you report it. In cases where the uptime guarantee cannot be fulfilled, the discount/time extension to be provided in cloud/virtual/vps/vds server and dedicated/physical/rental server services does not include 3rd party software/license fees. Possible uptime rights are valid for the relevant service and cannot be used or transferred for another service.
The uptime guarantee is not valid during the attacks to be made on the server by malicious people in order to keep the server down and during the previously specified server maintenance. For this reason, the interruption will not be reflected in the uptime rate.
You agree that ColdLayer will not provide any support for matters that do not cover the service you receive. ColdLayer has no obligation to provide software support and perform user operations (opening a email account/email settings, creating a database, website operations, etc.) for any hosting service received. In cloud/virtual/vps/vds server and dedicated/physical/rental server services, support is provided only for the initial delivery of the system, additional software installations and user operations are not covered by the support. In software services, ColdLayer is only responsible for delivering software that works smoothly.
In order to benefit from the support system, you must log in to your user control panel with your password and send a support notification from the Support Notification (Support Ticket) section. No information about the account is shared or any action is taken by other means (email, telephone, live support, contact form, etc.).
The concept of 24/7 support does not mean instantly that you can reach/receive your support notifications every time you call. Our support team tries to respond to your support notifications as quickly as possible. 24/7 support shows that it is working regardless of working hours, and the response you will receive to your support notification, depending on the intensity of the support team, is 24 hours on average, unless exceptional circumstances occur.
If you are purchasing a reseller hosting account/service, you are responsible for supporting your own users/customers. ColdLayer will not support reseller hosting users, users/customers. If the user/customer of any reseller hosting user contacts ColdLayer, ColdLayer has the right to suspend your account until it deals with your user/customer. In addition, our reseller hosting users are responsible for the content of their users'/customers' websites. In no way can ColdLayer be held responsible for any illegal behavior or contractual behavior of reseller hosting users by their users/customers.
ColdLayer reserves the right to reset the password of any cloud/virtual/vps/vds server and dedicated/physical/rental server service it offers. It is the users responsibility to keep a valid email address and root password registered in the ColdLayer system. Cloud/virtual/vps/vds server and dedicated/physical/rental servers are not backed up by ColdLayer, it is the user's responsibility to back up all data and backups.
You will not be charged an additional fee for the service you purchased during the service period you purchased, unless you purchase an additional feature or use outside the permitted limits. ColdLayer reserves the right to change the prices at the end of the service period and to renew the service with the new pricing.
By taking service from ColdLayer, you agree that you will not harm ColdLayer in any way, you will not cause any material/moral damage and you undertake to cover any material/moral damage caused.
By using services from ColdLayer, you agree not to impose any legal liability on ColdLayer. In such a case, you agree and undertake that you will cover all court and attorney costs within the requested period.
ColdLayer cannot be held responsible for any damage to your business. ColdLayer does not offer any warranty regarding the service(s) it provides. These include hardware failure, software/coding error, natural disasters, power outages, etc. including data loss, delays, interruptions, erroneous information delivery caused by ColdLayer and/or any ColdLayer employee, officer, officer, together with situations and events. ColdLayer will not accept responsibility if your data/information is obtained by third parties in a hack event that may occur.

If you think that you are not satisfied with the web hosting service provided by ColdLayer within 30 days from the first order date of your web hosting service, you can cancel your service from your user control panel and request a refund.
The user can use monthly periods for trial purposes, if he is not satisfied, he can cancel the service in the monthly period without extending it, and the web hosting package that is canceled in monthly periods is not within the scope of the money back guarantee, even if the user's first order is in a period of less than 1 year purchase.
Except for the ready-to-use web hosting packages created by ColdLayer, the hosting service created by the user in any product/service and their own web hosting package named Flexible (Flexible) is not covered by the money back guarantee.
Domain names, vps/vds, dedicated, server, vpn, ssl, ftp, cdn, email, software, licence, any product/service addon, etc. any product/service is not covered by the money back guarantee.
The refund guarantee does not cover accounts suspended/stopped due to non-compliance with the service agreement.
Prepayments, balances/credits, affiliate program commissions, bonuses and rewards added to your ColdLayer account are only for use in your ColdLayer account. It is not possible for the balance/credit in your ColdLayer account to be refunded or transferred to any non-ColdLayer financial instrument, converted into cash.
All refund payments are made within 30 business days. This period may vary depending on the payment method.
ColdLayer can include any registered user account in the affiliate program and the user has the right to use it or not.
The user earns 10% commission to the affiliate account of the inviting user from the first web hosting package purchased by each account for the accounts they invite with the unique invitation link created by ColdLayer. This commission has increasing rates as shown below.
The user, who uses an affiliate program that invites/refers, earns a commission to his account.
Earned commissions are instantly visible in the affiliate account, but in order for the commissions to be available, the new user who comes with the invitation/referral must not cancel the service and the money back guarantee period must have passed in order for the commission to be valid.
If the commissions earned have reached $100 USD (One Hundred American Dollars) or the equivalent of the amount in your affiliate account after meeting all the conditions, you can create a withdrawal request from your affiliate program account to your account.

ColdLayer reserves the right to add +10% premium commission fee on your balance/credit withdrawal request to your ColdLayer account for the commissions you earn.
